GoSUP Terms & Conditions

 

These terms and conditions, as may be amended from time to time, apply to all our services directly or indirectly.

By accessing, browsing and using our (mobile) website you acknowledge and agree to have read, understood and agreed to the terms and conditions set out below (including the privacy policy)

Definitions

"Primary" refers to the person making the booking for themselves individually or as a group 

"GoSUP", "us", "we" or "our" refers (the company)

 

Booking Policy

When booking a lesson(s), activity or hire/rental, the primary is accepting full responsibility for all persons who form part of that booking party. The booking forms a contract between the primary (booking party) with us for the duration of the lesson, activity or hire/rental. It is the responsibility of the primary to ensure all participants have read and understood these terms and conditions.

 

Rescheduling a booking

If at least 24hrs notice is given, every effort will be made to change your lesson date or time but this is subject to availability, tides and weather conditions. If we are unable to re schedule your activity to a suitable alternative date then a credit voucher or refund will be issued. No refunds are given to a booking change if made with less than 24hrs notice, a credit voucher will be offered.

 

Cancelling a booking

Cancelations up to 48hrs prior to the start of your activity will be given a full refund.

Cancelations less than 48 hours prior to the start of your activity will be given a credit voucher. 

Payments

All payment are either taken online or paid on the day in full before the activity takes place.

Credit Vouchers

All credit vouchers are valid for 12 months from the time of issue. 

Acknowledgement of Risk

The activity of paddle boarding (S.U.P), Wing surfing and wing foiling bears certain known and unanticipated risks, even under professional guidance.

Acceptance of Responsibility & Liability

It is the responsibility of the primary to ensure that themselves and all members who form part of their booking are aware that these activities entail risks. All participants expressly covenant to accept and assume all responsibility and risk for injury, death, illness or disease, or damage to third parties and their property arising from participation in these activities. Participation in this activity is purely voluntary, and all participants elect to participate in spite of the risks.

All participants hereby voluntarily release and forever discharge GoSUP, its agents, or employees, and all other persons or entities from any and all liability, claims, demands, actions or rights of action, which are related to, arise out of, or are in any way connected to participation in this activity.

It is the responsibility of the primary to ensure that themselves and all members who form part of their booking for board rental/hire, have the necessary experience set out on the booking hire form.

Medical & Fitness

It is the responsibility of the primary to ensure that all medical conditions, allergies, disabilities, and any medications are disclosed at the time of booking, or as soon as possible right up the the start of the activity if such conditions were not apparent at the time of booking. The primary must also ensure that each participant has filled out our activity disclaimer form. Failure to disclose any of this information or fill out the form may lead to the person(s) not being able to participate in the activity, with no refund being given. The activities require a reasonable level of fitness and must be able to swim at least 50m unaided.

It may be the discretion of the instructor to take a non swimmer with a high level of water confidence wearing a buoyancy aid.

It is the responsibility of the primary to ensure all members of their booking have a suitable level of fitness / health to undertake the activities booked.

Age Restrictions

Whilst there is no upper age restriction, physical fitness will determine suitability. We have a lower age limit of 8 years old for SUP lessons, but this decision is made on an individual basis and is totally at the discretion of the lead Instructor / Coach as its physical capability that determines lesson suitability. Minimum age for SUP Surf, wing foil coaching or wing foil kit hire is 18.

​Late arrival

All participants should arrive at least 20 Minutes before the start of the lesson. Lessons start promptly, you may be part of a mixed group, if the group has entered the water you will not be permitted to join the lesson, as the instructor cannot leave a group on the water unattended. If a same group booking is late, this will be deducted from your overall lesson time. Late arrivals will be rescheduled (may not be the same day). No refunds will be given for late arrivals. 

Weather Conditions

Weather is dynamic, we check the weather continuously, and make decisions days ahead based on forecasts, if on the day the Instructor/coach has deemed the weather conditions unsuitable or unsafe to run the lesson,  we will give you as much notice as practically possible as to the cancellation of your lesson. If we cannot reschedule within a 24 hour period we will offer you a credit voucher or a full refund.

Covid Booking Policy

If at anytime GoSUP cannot deliver your activity due to Covid restrictions being imposed a full refund will be given

Publicity Release

From time to time we take video's and photos for social media and marketing purposes.

All photos are the exclusive property of GoSUP.

Privacy Policy

We receive, collect and store any information you enter on our website or provide us in any other way. In addition, we collect the Internet protocol (IP) address used to connect your computer to the Internet; login; e-mail address; password; computer and connection information and purchase history. We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page. We also collect personally identifiable information (including name, email, password, communications); payment details (including credit card information), comments, feedback, product reviews, recommendations, and personal profile.

How we collect information?
When you conduct a transaction on our website, as part of the process, we collect personal information you give us such as your name, address and email address. Your personal information will be used for the specific reasons stated above only.

Why we collect such personal information?
We collect such Non-personal and Personal Information for the following purposes:

  1. To provide and operate the Services;

  2. To provide our Users with ongoing customer assistance and technical support;

  3. To be able to contact our Visitors and Users with general or personalized service-related notices and promotional messages;

  4. To create aggregated statistical data and other aggregated and/or inferred Non-personal Information, which we or our business partners may use to provide and improve our respective services; 

  5. To comply with any applicable laws and regulations.

How we store, use, share and disclose your site visitors' personal information?
Our company is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall. 

All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

How we communicate with our site visitors?
We may contact you to notify you regarding your account, to troubleshoot problems with your account, to resolve a dispute, to collect fees or monies owed, to poll your opinions through surveys or questionnaires, to send updates about our company, or as otherwise necessary to contact you to enforce our User Agreement, applicable national laws, and any agreement we may have with you. For these purposes we may contact you via email, telephone, text messages, and postal mail.

Privacy policy updates
We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.
